Delray Beach Justice Process for Juvenile Offenses
When an alleged juvenile offender has been arrested, he or she will be taken to a Juvenile Assessment Center (JAC) for processing. The location of the JAC depends on the county in which the alleged juvenile offender was arrested in:

Multiple agencies work at the JAC, including the State Attorney’s Office, Department of Juvenile Justice (DJJ), the School Police Youth Court, and the Intensive Delinquency Diversion Services.  The agencies will work together to recommend sanctions, but the DJJ will use a Detention Risk Assessment Instrument (DRAI) to determine whether a juvenile offender is released to his parents or remains in custody.

The DJJ makes a recommendation to either formally charge the alleged juvenile offender or allow him or her to enter into a diversion program. The State Attorney ultimately has the final decision in these matters.

It is important to understand that with some crimes, alleged juvenile offenders can be tried as adults in traditional criminal court where the possible penalties are far more serious. For this reason, it is critical to make sure your child has a lawyer as soon as possible so the matter can stay out of adult court.
